1. Acceptance of These Terms

By subscribing to The Care and Healing Lounge ("the Lounge", "the Service"), you ("the Member", "you") accept and agree to be bound by these Terms and Conditions ("these Terms"). If you do not agree with any part of these Terms, you must not subscribe to or use the Service. Your subscription is made available by Dr Ahmad Sufian's Cancer Clinical Services ("the Clinic", "we", "us").

2. The Service

The Lounge is an add-on layer of support offered to patients and caregivers seeking a more guided experience of cancer care. It includes digital concierge features such as a calming companion, oncology speed-dial coordination, and international liaison recommendations. The Service is supplementary and supportive only.

3. Eligibility & Your Information

To subscribe you must provide accurate, current, and complete information: your full name, identification number (Malaysian IC for Malaysian residents, or passport number for international members), country of residence, residential address, and a contact telephone number. You warrant that the details you submit are true and that you are authorised to use the identification document you provide. You must notify us of any change to these details during your membership.

4. Subscription Fee, Term & Cancellation

The membership fee is RM 350.00 per month, charged monthly in advance through Stripe (or such other payment processor as we may use). The minimum membership term is three (3) months. At the point of subscribing you may elect a membership duration of between three (3) and twelve (12) months. Your subscription renews automatically on a monthly basis at the end of each billing period until the end of your elected term, unless cancelled in accordance with these Terms.

You acknowledge and agree that because the Service is offered at a committed rate for a minimum term of three (3) months, the monthly fee for that minimum period is non-refundable except where required by applicable law. After the minimum term, and for the remainder of your elected duration, you may cancel future billing by giving written notice to the Clinic at least seven (7) days before your next billing date; cancellation takes effect at the end of the then-current paid period and no further charges apply. Refunds, where owing, will be processed in accordance with the Clinic's refund policy and applicable Malaysian law.

5. Ethical Use of the Service

You agree to use the Service honestly, lawfully, and in good faith, and only for your own personal health support. You must not misuse the Service, provide misleading or false information, attempt to obtain advice for a third party by misrepresenting their identity, or use the concierge to solicit prescriptions, controlled substances, or documentation that is not clinically warranted. The Clinic reserves the right to suspend or terminate membership and decline renewal where, in its reasonable opinion, the Service is being used in an unethical, abusive, fraudulent, or harmful manner, without refund for any period of misconduct.

6. The Service Does Not Replace Emergency or Urgent Care

The Lounge is a supportive and coordination service only. It is not a substitute for emergency medical services, urgent care, or the clinical judgement of your treating team. The Service does not provide a continuous-monitoring, ambulance dispatch, or emergency-response function, and the concierge features may not be available immediately or at all times. If you experience a medical emergency, worsening symptoms, or any condition that may pose a danger to your life or health, you must contact your local emergency services or attend the nearest emergency or urgent-care facility near your place of living without delay. You must not delay seeking such care in reliance on the Service.

7. Standards of Medical Care

The Service operates from Malaysia and is intended to complement, not replace, the standards of medical care applicable in your own jurisdiction. Any clinical advice, referral, or coordination you receive through the Service is subject to the law and regulatory standards of the place where the care is delivered, and to the clinical judgement of the responsible medical practitioners. You remain responsible for following the advice of your own treating physicians and for ensuring that any care you pursue complies with the laws and safety standards of the country in which you receive it.

8. Protection of Personal Data (PDPA)

The Clinic respects the privacy and confidentiality of your personal data and complies with the Personal Data Protection Act 2010 of Malaysia ("PDPA"). The personal information you provide on subscribing — including your name, identification document number, country, address, and contact details — is collected for the purposes of administering your membership, verifying your identity, providing the Service, billing, and maintaining clinical records where required. Your data is processed securely, handled in accordance with the PDPA, and not disclosed to unauthorised third parties. By subscribing you consent to the collection, use, storage, and disclosure of your personal data for these purposes. Payment information is processed by our payment provider (Stripe) under its own security standards; the Clinic does not store your full card details. You may request access to, correction of, or withdrawal of consent for processing of your personal data by contacting the Clinic.

9. Limitation of Liability

To the fullest extent permitted by law, the Clinic, Dr Ahmad Sufian, their officers, employees, and agents shall not be liable for any indirect, incidental, consequential, or special damages, or for any loss arising from any reliance on, or delay or inability to use, the Service, including any reliance that is contrary to Section 6 above. The Service is provided on a best-efforts and reasonable-care basis and, save for liability that cannot be excluded by law, no guarantee of a particular clinical outcome is given or implied.

10. Changes to These Terms

We may update these Terms from time to time. Where any change is material we will make reasonable efforts to notify existing members in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia, and the parties submit to the exclusive jurisdiction of the courts of Malaysia, without prejudice to any mandatory consumer-protection rights you may have in your own jurisdiction.
